Many team drivers tell me that they just won't go by the new HOS rules for sleeper teams.(can't split 10 off duty) I know that I couldn't do it. What are the penaltys for getting caught with fudged books? Especially if you are involved in an accident, and the driver's book shows him in the sleeper.
No reason to get caught. That's what loose leaf logs are for. The truck and driver(s) should be "legal" whenever in operation. A sleeper team has all the options and should never have a log problem. The main way folks get into trouble is when the truck is somewhere other than where the driver's log says it is. This shouldn't be an issue for a sleeper team.
In an accident. A inoperative marker light bulb will be used by the plaintiff's (read victim's) lawyer at a civil trial to show evidence of willful negligence on the part of the party with the deepest pockets. If the lawyer can use your logs against you, consider it done. And, the lawyer's investigative team will make the DOT look like rank amateurs.
Loose leaf logs can't hide facts. While loose leaf may suffice for a 7 day review during a road side the loose leaf will not hide false logs for a 30 day period when the logs are compared to repair receipts, fuel receipts, roadside inspections, maintenance records, and bills of ladings.
When a driver's run is recreated on a leg to leg basis the logs rarely hide all of the discrepancies.
Penalties for false logs discovered during a roadside inspection vary from $56 to $2,500 depending on the state. It is suspected California has the stiffest penalties.
When a false log is discovered by the US DOT the penalty may be assessed to the driver and the carrier. If it is substaniated a false log was deliberate to conceal an 11/14 or 60/70 hour rule a single count can be as much as $11,000 for the carrier and $2,500 for the driver.
Drivers that falsify their logs face jail time for a fatal accident.
Due to the number of drivers that continue to falsify their logs drivers can expect to see electronic on board recorders within the next seven to ten years.

Loose leaf is only as good as the driver. As long as u match all documented times . Play with the rest. Think and plan ahead for fueling times,
or better yet pay cash . When use fuel card there is no time on ticket,but when
statement comes at the end of month each and every card use has documented time and that is what DOT uses to catch you.
As for as shipping document , some have time on them some do not.
None of mine do.
Just use some common sense about it. There is always a way to rework it.
Log miles devide by 7mph less then speed limit in stead of actual time.
Put waiting to load time on sleeper birth.The list goes on and on.

it's idiots like you that are the reason that there will be Electronic Logs which you will not be able to adjust or modify whatsoever. It's only a matter of time. In that case, good luck
